INTENT TO ENROLL

ENROLLMENT/CANCELLATION POLICY

By agreeing to this Intent to Enroll form, you are enrolling in the individual course(s), program(s) and/or degree(s) listed above (each hereinafter referred to as a “Program”). Pangea-Learning and its Program providers (collectively “Pangea”) reserve the right to change Programs and their requirements. Any changes will be communicated to participants prior to the Program start date.  

Programs are subject to cancellation at Pangea’s discretion. If a Program is canceled due to low enrollment, technical issues, or any other reason Pangea deems necessary, registered participants will be notified. Participants will have the choice of either rescheduling to another term or receiving a 100% tuition refund.  

REGISTRATION & ONLINE LEARNING MANAGEMENT SYSTEM ACCESS 

Once registered, you will receive a confirmation email with your username and password for the learning management system (LMS). You will be able to access the Program and all materials on the Program start date.   

Participants are expected to participate from day one of the Program. Upon immediately gaining Program access, participants should check the Program’s announcement section for communications from the Program provider.  Participants should ensure they have the appropriate equipment for attending and engaging in the Program prior to the start of the Program since most of the content is digital.  

WITHDRAWAL/RESCHEDULE POLICY 

You may withdraw from the Program and receive a refund in accordance with the Refund Policy of the Program provider.  Once enrolled, you may also reschedule your Program start date to a later date, consistent with the Rescheduling Policy of the Program provider. Once classes begin, you will not receive a refund if you elect to withdraw from the Program. Pangea can assist you with making the necessary arrangements should you need to delay your Program start or request a refund. To provide notice of withdrawal, you must email Pangea prior to 12am EST on the first day of class.  

Exemptions to the withdrawal policy may only be granted in cases of documented military deployments, death in the immediate family, or serious illness, consistent with the withdrawal policy of the Program provider.

PROGRAM COMPLETION 

 Depending on the Program selected, your Program may allow you to complete the entire Program at any time within your scheduled session time frame. You may work on any section of the Program at any time of the day or night. The Program’s video components may be reviewed as many times as you like during the session. In order to pass the program/course, you must achieve the grade criteria of the Program provider.   

Certificate Delivery: Certificates of Achievement or similar credentials are available for download upon completing the Program. Certificates will not be available for download if there is an outstanding balance on your account, or if you have not completed all Program requirements.  

UPDATING YOUR CONTACT INFORMATION 

It is your responsibility to keep your primary email address up to date so that Pangea can communicate with you electronically. You understand and agree that if Pangea sends you an electronic communication, but you do not receive it because your primary email address on file is incorrect, out of date, blocked by your service provider, or you are otherwise unable to receive electronic communications, Pangea will be deemed to have provided the communication to you.   

Please note that if you use a spam filter that blocks or re-routes emails from senders not listed in your email address book, you must add Pangea to your email address book so that you will be able to receive the communications we send you.   
  
You can update your primary email address at any time by contacting Pangea via email at hello@pangea-learning.com. If your email address becomes invalid such that electronic communications sent to you by Pangea are returned, Pangea may deem your Account to be inactive, and you will not be able to transact any activity using your Account until we receive a valid, working, primary email address from you.  

PAYMENT RESPONSIBILITIES

Arrangements for the payment of your Program tuition must be made prior to the start of class. You agree to the payment terms outlined above, and further agree that you shall remain personally liable for all payments due under this agreement.  

If any third-party payment arrangements (including but not limited to corporate tuition assistance, scholarships, private loans) do not occur for any reason or are insufficient to cover all costs; or in the event that any arranged credit card payment declines, you are not absolved of personal responsibility for payment, and Pangea will seek payment from you directly.  

You also agree that you shall be individually liable for all fees and expenses of, for and incidental to the collection of all amounts due in this Agreement; this shall include, without limitation, reasonable collection fees incurred with third-party agencies, and reasonable attorney and paralegal fees and other costs incurred in litigation, mediation, arbitration, and bankruptcy proceedings, including appeals.  

No official documents of completion of the Program will be awarded by the Program provider until payment is received in full. If at any time you have questions about your account, please contact Pangea.  

Payment Plans: If your payment terms include a payment plan, you agree to allow Pangea to charge your credit card referenced above on the listed dates. You agree Pangea may acquire any information necessary to complete the processing of any payment plan request. Necessary credit information may include employment verification, consumer credit balances, payments, and history. You unconditionally agree (a) to make full and punctual payment of all charges incurred or payable as itemized above, including any and all interest, late fees or other charges payable in connection therewith; (b) that your liability for any obligation shall not be discharged or limited by a release or discharge from the program, disabilities, or any other matter whatsoever except payment in full of all amounts due; and (c) to waive notice of presentment, payment, acceptance, demand, existence of debt, and all other notices to which you might be entitled.

International Banking Fee: Any international banking fee associated with your payment plan or method of payment is your responsibility. 

PROCESSING OF PAYMENTS 

Participant and corporate payments made on behalf of participants are processed by Pangea and should be submitted directly to them. Veteran’s benefits may be applicable to the Program, depending on the Program provider.  Please consult with Pangea regarding this issue. 

By agreeing, you acknowledge that the payment responsibilities outlined above are an agreement between you and Pangea. If you are receiving third-party benefits from another agency or institution, you may have additional financial and/or other contractual obligations to these parties as well, which are separate from those listed in this document. If you are receiving tuition benefits from corporations, agencies and/or organizations, you should check any benefits restrictions prior to agreement.

WAIVER OF FEDERAL NOTICE REQUIREMENTS 

The privacy of your education records is protected by federal law (FERPA, for U.S. residents and FIPPA, for Canadian residents). If any of the tuition, or fees listed above, shall be paid on your behalf by a third party (for example, via a tuition assistance program offered by your employer or a governmental agency), those third parties may wish to review your education records. By agreeing, you acknowledge that any third party who is making payment may obtain and review your education records, and you agree that you shall not receive further notice from Pangea each time this information is provided. 

If you have submitted an application for a reasonable accommodation under the Americans with Disabilities Act, or its related regulations that have been granted, you understand and agree that your professor and other support staff will be advised of your status without further notice to you. 

CHOICE OF LAW AND JURISDICTION 

Except for billing and collections matters conducted by Pangea, this Intent-to-Enroll shall be governed by, and construed in accordance with, the laws of the State of California. Any controversy, claim or dispute, (other than controversies, claims or disputes related to failure to pay any amounts due or owing Pangea, or alleged, possible or actual violations by or on behalf of applicants, participants or enrollees of applicable laws, rules, regulations or orders, or Pangea policies, procedures, rules or guidelines), arising out of or relating to this agreement, the subject matter thereof, or our relationship shall be subject to non-binding, confidential arbitration in Riverside County, California pursuant to rules applicable to such disputes. Controversies, claims, or disputes related to failure to pay any amounts due or owing to Pangea shall be subject to non-binding, confidential arbitration in Riverside County, California. The arbitrators will have no authority to award punitive or other damages not measured by the prevailing party’s actual damages or as permitted or required by statute. Any claims, in arbitration or otherwise, must be brought in the party’s individual capacity and not as a plaintiff, class representative or class member in any purported class. By agreeing, you expressly submit to the exclusive jurisdiction of, and agree to exclusive venue in, the state courts of Riverside County, California, for any proceeding arising out of or in connection with these terms, except for billing and collections matters conducted by Pangea for which you expressly submit to the exclusive jurisdiction of, and agree to exclusive venue, in the state courts of, or non-binding confidential arbitration in, Riverside County, California.  
  
An electronic copy of this authorization may be deemed to be the equivalent of the original and may be used as a duplicate original.  

I HAVE READ AND AGREE TO THE TERMS AND CONDITIONS OF THIS PROGRAM ENROLLMENT FORM. 

My agreement signifies:

  • My intent is to enroll in a Program with a Program provider of Pangea.   
  • My agreement to comply with the terms and conditions described above and the policies of Pangea and its Program providers.   
  • I understand that Pangea-Learning, Inc. is an authorized representative of its Program providers and may act on behalf of such Program providers in connection with the updating of my contact information, collection of my payment, processing of my payment, and provision of any required notifications to me.
